Website terms of use
These terms govern your use of this website. They are not our services agreement — that is a separate document provided with any proposal.
Last updated: to be set at launch
1. Acceptance
This website is operated by Next Cyber Pty Ltd (ABN 17 700 967 826, ACN 700 967 826). By accessing or using it, you agree to these terms. If you do not agree, please do not use the site.
2. Information is general in nature
Everything on this website is general information about our services and about cyber security practice. It is not tailored advice and does not take account of your particular circumstances, systems or obligations. Do not act on it as though it were an assessment of your environment.
Nothing here is legal, financial or insurance advice. Where we describe regulatory frameworks — including the Australian Privacy Principles, the Notifiable Data Breaches scheme and the ACSC Essential Eight — those descriptions are summaries in plain language. The published source documents are authoritative and are periodically revised.
3. No engagement is created
Submitting an enquiry through this site does not create a client relationship or any obligation on either party. A relationship begins only when a written services agreement is executed by both of us.
4. Intellectual property
All content on this site — text, images, layout, code and the Next Cyber name and marks — is owned by or licensed to Next Cyber Pty Ltd. You may view, download and print pages for your own internal, non-commercial purposes. You may not republish, sell, or use our name or marks without written permission.
Third-party names and marks appearing on this site remain the property of their respective owners and are used for identification only.
5. Acceptable use
You must not:
- Use the site in any way that breaches Australian law.
- Attempt to gain unauthorised access to the site or any connected system, other than under our vulnerability disclosure process on the security page.
- Interfere with the site's availability or performance.
- Use automated means to harvest content or contact details.
- Submit false information, or another person's details without their authority, through our enquiry form.
6. Availability
We aim to keep the site available but do not warrant that it will be uninterrupted or error free. We may change, suspend or withdraw any part of it without notice.
7. External links
Where we link to third-party sites, we do so for convenience. We do not control them and are not responsible for their content, availability or privacy practices.
8. Liability
To the extent permitted by law, we exclude liability for any loss or damage arising from your use of, or reliance on, this website.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can be limited but not excluded, it is limited to resupplying the relevant information or the cost of resupply.
9. Privacy
Our handling of personal information is described in our privacy policy, which forms part of these terms.
10. Changes
We may update these terms from time to time. The version published here is the current one, and continued use of the site after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that state.
